Crystal Babin posted the following video in September 2024 that highlighted how she lost custody of her son, however, she repeatedly lies about this situation when compared to the family court documents. The following document will provide evidence from the court's and C’s sides so that this situation can finally be resolved.

“How I Lost Custody of My Son”

First Lie

C claims that her son's father moved to GB when their son was 2

The truth as per Page 5, Sec 22: The child’s father was employed at a facility up until 2020 when he moved/ transferred to GB. The child was born in 2015 meaning he was around the age of 4 or 5.

Second Lie

Crystal claims that her son's father was “coming around every second weekend and it was like pulling his arm to do that”

The truth as per Page 2, Sec 6: The timeline is a bit all over the place with her claims but in 2018 (2019 was when it was granted) both parties consented to 50/50 custody. This was before the child’s father moved to GB and this was before Crystal met her last ex-husband. Before, the child’s father had very liberal parenting time which means the parent can make informal arrangements with said child.

As per Page 11, Sec 14: The courts made note that the child's father has, “ walked the walk, frequently driving from GB to RC to pick up his son and return him to his mother. This is a significant commute”

Ps. This is an almost 2 hr drive one way, totaling 4 hours

Third Lie

Crystal’s relationship timeline with her last ex-husband just does not make any sense

The truth as per Page 1, Section 1: Her sons father and she separated in 2016 and divorced in 2019. Crystal claims that she met her last ex husband after her seperation which would mean they would have met/dated around 2016-2017. Four months into their relationship she finds out he has a girlfriend and a child so they break up, C finds herself single for the next 3 years which would mean this would be 2019-2020.

As per Page 4, Section 19: C’s last ex-husband testifies that he began dating Crystal in October 2020. Crystal testifies and says they began dating in September 2020. Both parties can’t seem to get their story straight? Or is C once again fabricating a relationship timeline that never was? What happened to first dating in 2016-2017?

Fourth Lie

“ The court documents say exactly this,

my husband lied about everything

his job

renting

how many kids he has….”

The truth as per Page 4, Section 15: In the affidavits of both C and her last ex husband (they were married at this time) he is described as a manager for a drywall and construction company.

However…. In Sec. 16 during his oral testimony he in fact owns his own business, is an independent contractor and has five employees

In Sec 17: In C’s affidavit she claims that he owns his own home but in HIS affidavit he says he LIVES in a home. While testifying he agreed with C’s counsel that he had a mortgage……

However…… when questioned further by the court he indicated that he pays rent and does not pay a mortgage.

The court had the following to say in Sec. 18:

“ The Court does make allowances for witnesses to be imprecise and does not

presumptively question the credibility of witnesses because of innocent errors.

However, inconsistencies in basic facts such as whether one is an employee or an

employer and whether one rents or owns a home cause the Court to have some

concern as to the credibility of a witness.”

As per Page 12, Sec 54: Her last ex-husband has three children which is true as exhibited on his Facebook profile, C says this is a lie.

Fifth Lie

C claims she wasn’t able to work and always tried to work

The truth as per Page 10, Sec 42: When C was contemplating a move to GB following the completion of her recent training she was satisfied there were employment prospects for her.

On Page 12, Sec 53: The child's grandmother is willing to provide after-school care and other care for the parties son

Both of these statements contradict C’s resistance to working a full time job due to her son not having after-school care. C also has another excuse where she claims she can’t work due to her custody agreement of 50/50.

Sixth Lie

C claims her son knows nothing about GB and that this place is foreign to him

The truth as per Page 9, Sec 37: Direct quote from the courts:

“He is familiar

with the community of Glace Bay and the neighbourhood where extended family

members reside in that community. He is familiar with the home in which his

father resides at Glace Bay”
